What is an Encumbrance Certificate?

An Encumbrance Certificate (EC) is an official property document that records registered transactions and certain registered liabilities or encumbrances associated with a property during a specified period.

Why is an Encumbrance Certificate important?

An EC helps property buyers review the registered transaction history of a property and identify certain registered mortgages, charges, or other transactions before purchasing.

Is an Encumbrance Certificate mandatory for buying property?

The requirement can vary depending on the transaction, state, lender, and registration process. However, obtaining and reviewing an EC is an important part of property due diligence.

How can I obtain an Encumbrance Certificate?

An EC can generally be obtained through the relevant sub-registrar's office or the state's online registration portal, where online services are available.

What information is required to apply for an EC?

Depending on the state, you may need details such as the property's survey number, plot number, registration details, property description, and the period for which the EC is required.

Does an EC prove that the property has a clear title?

No. An EC is an important due-diligence document, but it does not by itself guarantee that the property has a completely clear title. Title documents and other legal records should also be examined.

Does an EC show property loans?

A registered mortgage or charge may appear in the EC if it has been recorded in the relevant registration records. Buyers should also obtain appropriate loan-closure or release documents where applicable.

How many years of EC should I obtain?

The appropriate period depends on the property's history, transaction requirements, lender requirements, and legal advice. For older properties, a longer period may be appropriate to review the ownership and transaction history.

Should I check the EC before buying a plot, flat, or commercial property?

Yes. Reviewing the EC is an important step before purchasing residential, commercial, or land property. It should be checked along with title deeds, approvals, tax records, RERA details where applicable, and other relevant documents.
